Circular contracts may seem complex and elusive, yet they are essential for enabling circularity in practice. This paper explores how traditional legal frameworks—based on ownership rights, obligations, and contractual freedom—can be reshaped to facilitate the multiple lifecycles of building materials.

Central issues include: whether a producer retains ownership or transfers it, how risks such as accession can be mitigated, and how circular clauses like buy-back rights, leasing models, or resale obligations can be structured and enforced across successive owners.

The MASCO concept is presented as an investment and operational model that ensures durable building materials remain in circulation, balancing the interests of producers, clients, and financiers. The report provides a roadmap of legal tools and contract clauses designed to maximize product circularity while safeguarding all parties involved.
