In a circular economy, the producer should stay responsible for its products. Under Belgian law, that responsibility sits with ownership. But once a wall is built into a building, the law may treat it as part of that building, and the producer loses ownership.


Notary Benjamin Verheye and lawyer Marian Rapsaet map four routes: rental or sale, with or without that risk. They show how buyback rights, registered pledges, retention of title and building rights protect the producer, and how a MASCO can act as a financing, investment and operational vehicle.
